<\/h1>\nRequisitos para casarte en Rep\u00fablica Dominicana<\/strong><\/span><\/h1>\nLa ley en la Rep\u00fablica Dominicana reconoce dos clases de matrimonio: el civil<\/strong>, que se contrae de acuerdo con los preceptos de la ley civil; y el religioso<\/strong>, celebrado con sujeci\u00f3n a las normas del Derecho Can\u00f3nico.<\/span><\/p>\n![\"separador-web-eventos-y-catering\"](\"http:\/\/www.eventosycateringrd.com\/wp-content\/uploads\/2014\/04\/separador-web-eventos-y-catering.png\")

El matrimonio civil<\/span><\/h2>\nEl matrimonio civil se origina del contrato celebrado entre un hombre y una mujer que han otorgado su libre consentimiento para casarse y cuentan con la capacidad para verificar este acto<\/strong>. Para poder contraer matrimonio en la Rep\u00fablica Dominicana, es necesario que las partes cumplan los siguientes requisitos y tr\u00e1mites:<\/span><\/p>\n\n- Las partes deben otorgar su libre consentimiento<\/strong>. Cualquier consentimiento requerido para el matrimonio deber\u00e1 expresarse por escrito mediante acto aut\u00e9ntico o bajo firma privada, debidamente legalizado, a menos que las personas que deban darlo concurran al mismo y conste su consentimiento en el acta que lo instrumente.<\/span><\/li>\n<\/ul>\n
\n- Los menores de 18 a\u00f1os deben contar con el consentimiento de sus padres<\/strong> o del padre superviviente sin el cual no pueden contraer matrimonio.<\/span><\/li>\n<\/ul>\n
\n- El hombre menor de 16 a\u00f1os cumplidos y la mujer antes de cumplir los 15 no pueden contraer matrimonio<\/strong>; pero el Juez de Primera Instancia puede, por razones atendibles, conceder la dispensa de edad.<\/span><\/li>\n<\/ul>\n
No se puede contraer matrimonio antes de la disoluci\u00f3n de un matrimonio precedente<\/strong>. En todo caso la mujer divorciada no podr\u00e1 contraer nuevo matrimonio sino diez (10) meses despu\u00e9s de que el divorcio haya llegado a ser definitivo, a menos que su nuevo marido sea el mismo de quien se ha divorciado.<\/span><\/p>\n<\/p>\n
Los extranjeros que desean contraer matrimonio en el pa\u00eds \u00fanicamente deber\u00e1n presentar:<\/span><\/strong><\/span><\/h3>\n\n\n- Su pasaporte en original y copia.<\/span><\/strong><\/li>\n<\/ul>\n<\/ul>\n
\n\n- Carta de solter\u00eda de la Embajada del pa\u00eds de procedencia.<\/span><\/strong><\/li>\n<\/ul>\n<\/ul>\n
\n- La tarjeta de turista, o su tarjeta de residencia<\/strong> y\/o c\u00e9dula de identidad personal de extranjero, si la tuviere.<\/span><\/li>\n<\/ul>\n
El matrimonio civil debe celebrarse p\u00fablicamente ante un Oficial del Estado Civil<\/strong>. La ley exige ciertos requisitos de publicidad anteriores a la celebraci\u00f3n del matrimonio consistentes en la publicaci\u00f3n de avisos sobre el matrimonio. No obstante, el Oficial del Estado Civil, al momento de la celebraci\u00f3n del matrimonio, puede dispensar a los contrayentes de este requisito por razones atendibles, haci\u00e9ndolo constar en el Certificado u Acta de Matrimonio.<\/span><\/p>\nUna vez cumplidas estas formalidades, el matrimonio se celebrar\u00e1 ante el Oficial del domicilio de una de las partes<\/strong>, en presencia de los testigos requeridos. Al momento de la celebraci\u00f3n del matrimonio el Oficial del Estado Civil preguntar\u00e1 a los contrayentes, as\u00ed como a los testigos y dem\u00e1s personas que autoricen el matrimonio, si se ha celebrado o no alg\u00fan contrato entre ellos y en caso afirmativo, indiquen la fecha del mismo y citen el nombre del Notario ante quien se efectu\u00f3.<\/span><\/p>\nEl acta de matrimonio deber\u00e1 contener los nombres y apellidos de los contrayentes, su consentimiento, la declaraci\u00f3n de que han quedado unidos por dicho v\u00ednculo y la fecha del acto<\/strong>. Este acto ser\u00e1 firmado por el funcionario actuante, por lo contrayentes y testigos y posteriormente se proceder\u00e1 a la inscripci\u00f3n del matrimonio en los registros del estado civil correspondiente.<\/span><\/p>\n* El matrimonio civil se disuelve por el divorcio o por la muerte de uno de los c\u00f3nyuges.<\/span><\/p>\n\u00a0<\/p>\n
El matrimonio can\u00f3nico<\/span><\/h2>\nEl matrimonio cat\u00f3lico produce los mismos efectos legales que el matrimonio civil<\/strong>. <\/span><\/p>\nEl p\u00e1rroco debe enviar una copia textual del acta de su celebraci\u00f3n al Oficial del Estado Civil competente dentro de los 3 d\u00edas que siguen a la solemnizaci\u00f3n de dicho matrimonio can\u00f3nico<\/strong>, con la finalidad de que \u00e9ste proceda a la transcripci\u00f3n en los registros civiles de lugar. El matrimonio civil debe celebrarse p\u00fablicamente ante un Oficial del Estado Civil<\/strong>. La ley exige ciertos requisitos de publicidad anteriores a la celebraci\u00f3n del matrimonio consistentes en la publicaci\u00f3n de avisos sobre el matrimonio. No obstante, el Oficial del Estado Civil, al momento de la celebraci\u00f3n del matrimonio, puede dispensar a los contrayentes de este requisito por razones atendibles, haci\u00e9ndolo constar en el Certificado u Acta de Matrimonio.<\/span><\/p>\n
Una vez cumplidas estas formalidades, el matrimonio se celebrar\u00e1 ante el Oficial del domicilio de una de las partes<\/strong>, en presencia de los testigos requeridos. Al momento de la celebraci\u00f3n del matrimonio el Oficial del Estado Civil preguntar\u00e1 a los contrayentes, as\u00ed como a los testigos y dem\u00e1s personas que autoricen el matrimonio, si se ha celebrado o no alg\u00fan contrato entre ellos y en caso afirmativo, indiquen la fecha del mismo y citen el nombre del Notario ante quien se efectu\u00f3.<\/span><\/p>\n
El acta de matrimonio deber\u00e1 contener los nombres y apellidos de los contrayentes, su consentimiento, la declaraci\u00f3n de que han quedado unidos por dicho v\u00ednculo y la fecha del acto<\/strong>. Este acto ser\u00e1 firmado por el funcionario actuante, por lo contrayentes y testigos y posteriormente se proceder\u00e1 a la inscripci\u00f3n del matrimonio en los registros del estado civil correspondiente.<\/span><\/p>\n
